1. Scope of the Terms of Use
These Terms of Use govern access to and use of the Sport Profileo platform (app.sportprofileo.com) and its athlete and coach assessment solutions (PCQ, PCQ 360, PAQ and PAQ 180).
Use of the platform implies full and unconditional acceptance of these Terms of Use.
2. Purpose of the Platform
The purpose of the platform is to enable its users to implement solutions for assessing the mental or behavioural competencies of athletes and coaches in high-performance sport or talent development contexts.
In particular, the platform enables information relating to the mental and behavioural competencies of athletes and coaches to be collected through questionnaires completed by athletes, coaches and members of their sporting environment. Based on the responses to these questionnaires, the platform generates assessment reports, which are made available to users.
The assessment solutions available through the platform are intended to support athletes and coaches in developing their competencies and managing their career development. Subject to the conditions explained to users during their training in the use of the solutions, they may also be used to inform recruitment or career management decisions concerning athletes or coaches made by sports organisations.
The platform is a technical tool for collecting and reporting information. Content entered on the platform is provided under the sole responsibility of its authors.
The platform is not intended to receive or process reports of criminal offences or situations involving danger to individuals. Users remain solely responsible for complying with any legal or professional reporting obligations applicable to them, particularly where they become aware of situations that may involve a serious risk to an individual or acts of violence, abuse or mistreatment.
3. Users
The platform is accessible to individuals who have been duly trained in the use of the platform and its assessment solutions (mental performance consultants, sport psychologists, coaches, consultants and trainers).
Each user is responsible for their use of the platform, including any information they enter into it.
4. User Obligations
4.1 – General Obligations
The user agrees to:
– Respect the fundamental rights of the individuals being assessed;
– Ensure that athletes and coaches participate freely and voluntarily in any assessments initiated by the user;
– Use assessment results solely for a legitimate professional purpose for which the consent of the individuals being assessed has been obtained;
– Refrain from entering any discriminatory, insulting, violent, defamatory or unlawful content on the platform;
– Comply with applicable recruitment legislation when psychometric assessment solutions are used to inform recruitment decisions;
– Where appropriate, make the necessary reports to the competent authorities when the user becomes aware, including through information collected via the platform, of a situation involving a serious risk to an individual or acts of violence, mistreatment or abuse.
4.2 – Intellectual Property
It is strictly prohibited to:
– Copy, reproduce or modify the content of the assessment solutions, assessment reports or any other content available on the platform;
– Develop or market assessment solutions based on the assessment solutions available through the platform.
5. Use of the Assessment Solutions
5.1 – Rules of Use
Users may create assessment projects on the platform. As part of these projects, they may invite athletes, coaches and members of their sporting environment to complete assessment questionnaires.
The user agrees to:
– Ensure that individuals have agreed to the entry of their personal data on the platform for the purpose of inviting them to participate;
– Ensure that individuals invited to complete assessment questionnaires have consented to participate;
– Where an assessment involves members of the assessed individual’s sporting environment (PCQ 360 or PAQ 180), inform the assessed individual of the need to obtain the consent of those individuals before their personal data are entered on the platform and before they participate in the assessment.
5.2 – Minors
The user must obtain the consent of the legal representative(s) of a minor before sending the minor an invitation to complete an assessment.
Where an assessment involves members of the assessed individual’s sporting environment (PCQ 360 or PAQ 180), the user must inform the assessed individual that, before involving any minors from their sporting environment in the assessment, the legal representative(s) of those minors must be informed and their prior consent obtained for the minors’ participation in the assessment.
5.3 – Storage and Disclosure of Assessment Reports
The user agrees to:
– Store assessment reports securely;
– Not disclose assessment reports to third parties without the consent of the individuals concerned;
– Delete any assessment reports in their possession after a maximum period of 24 months, in accordance with good practice, unless the assessed individual has consented to their continued retention.
6. Personal Data Protection
Personal data entered by users on the platform will be processed by Tailor H, the legal entity that markets the Sport Profileo solutions, in accordance with the GDPR and Tailor H’s Personal Data Policy, available on the Sport Profileo website.
Tailor H ensures that users can exercise their rights in relation to their personal data, including their rights to information, access, rectification, erasure, data portability and objection. Users may exercise these rights by contacting: data@sportprofileo.com.
Tailor H undertakes to implement all necessary technical and organisational measures to protect users’ personal data.
Users undertake to comply with the GDPR when processing personal data, whether their own data, the data of assessed individuals or the data of members of the assessed individuals’ sporting environment.
7. Reporting Serious Situations
When using the platform and its assessment solutions, users may become aware, including through questionnaire responses or discussions with assessed individuals, of information that may indicate:
– A serious and imminent risk to an individual;
– Acts of violence, mistreatment, abuse or neglect, particularly against a vulnerable person or a minor;
– More generally, any situation that may constitute a criminal offence or require reporting to the competent administrative or judicial authorities.
In such circumstances, it is the user’s sole responsibility to assess the significance of the information and, where appropriate, take the necessary steps to report the situation to the competent administrative or judicial authorities.
Tailor H, in its capacity as the publisher of the platform and provider of technical information-gathering solutions, does not participate in the analysis, classification or handling of such situations and is not required to make reports on behalf of users.
The platform is a technical tool for collecting and reporting information. Tailor H does not undertake to monitor, moderate or supervise content entered by platform users or questionnaire respondents, except where specifically required by law.
As information collected through the platform may be confidential and, in certain circumstances, anonymised, the user acknowledges that the identity of the person who submitted a comment or raised a concern may not be directly accessible. In the situations described above, the user may nevertheless contact Tailor H so that, in compliance with applicable legal requirements, the conditions under which additional information may be disclosed to the competent authorities can be considered.
Accordingly, responsibility for reporting such situations and for taking appropriate action in response to information brought to the user’s attention rests solely with the user. Tailor H shall not be held liable for any failure or inadequacy on the user’s part in taking such action.
8. User Account
The user is responsible for all actions carried out through their account.
Tailor H may suspend or terminate an account in the event of:
– A breach of these Terms of Use;
– Fraudulent, abusive or unethical use of the platform.
9. Limitation of Liability
Tailor H implements all necessary measures to ensure the availability and security of the platform. However, Tailor H shall not be held liable for:
– Inappropriate use of the assessment solutions by the user;
– Improper or incorrect interpretation of assessment results;
– Indirect loss or damage arising from the use of the platform.

11. Admendments to the Terms of Use
Tailor H may amend these Terms of Use. Users will be informed of any material changes and may be required to accept the updated version.
12. Governing Law and Language
These Terms of Use are governed by French law.
Any dispute that cannot be resolved amicably shall be submitted to the competent French courts.
These Terms of Use may be made available in languages other than French for users’ convenience. In the event of any discrepancy, inconsistency or difference of interpretation between the French version and any translated version, the French version shall prevail.
